The undersigned NEW OWNERS of 2024 Playhouse donated by Tolin Designs, LLC., agree to defend, indemnify and hold harmless Tolin Designs, LLC Wishes Can Happen; News-Talk 1480 WHBC; Mix94.l, AultCare and all sponsors of2024 Wish-A-Thon from any and all claims arising from the transportation, construction, supervision, maintenance, or any potential claim of any potential liability, future claims, demands, actions, damages, costs, expenses, loss of services and/or causes of action of any kind or character arising from the use of this structure. 

The condition and construction of this structure is "as is." The materials, labor and time involved to build and deliver the structure have been donated and there are no warranties, express or implied, that will be conveyed to the NEW OWNERS.

The NEW OWNERS are responsible for a suitable location and/or pad to place the structure. Placement of the structure on site will be at the discretion of and subject to the limitations of the transport party. If additional materials or equipment are deemed necessary to relocate the structure, it will be the responsibility of the NEW OWNERS to coordinate and pay for any additional services. 

Delivery included within 25 miles, up to 50 miles but with fee. Must be an approved place for placement (no hills, etc.), Must be a flat surface with easy access for trailer and skid steer. Required to sign a Hold Harmless agreement between Tolin Designs and winner.
